Terms of Service

These Terms of Service ("Terms") govern your access to and use of kiloagency.org (the "Site") and the website design, development, and marketing services provided by KILO LLC ("KILO," "we," "us," or "our"). By using the Site or engaging our Services, you agree to these Terms. If you do not agree, please do not use the Site or Services.

Our Services

KILO designs and builds custom websites and provides related marketing services for glass & aluminum installers. The specific scope, deliverables, and price of any engagement are set out in a separate proposal or written agreement between you and KILO. If that agreement conflicts with these Terms, the signed agreement controls for that engagement.

Eligibility

You must be at least 18 years old and able to enter into a binding contract to use our Services.

Client Responsibilities

To let us do our best work, you agree to:

• provide accurate information and the content, access, and approvals we need to complete the work;
• review drafts and give timely feedback;
• hold the rights to any logos, images, text, or other materials you supply to us;
• and use the Site and Services lawfully.

Fees and Payment

Fees, billing schedule, and payment terms for each engagement are set out in your proposal or agreement. Unless stated otherwise, invoices are due on receipt, and work may be paused on overdue accounts.

Satisfaction Guarantee

We stand behind our work with a simple promise: if we don’t deliver a website that meets your expectations within 30 days of going live, you get a full refund, no questions asked. We revise until you are happy with the result. This guarantee applies to the design and build of your website. It is not a guarantee of any specific business outcome. We do not and cannot promise a particular Google ranking, search position, or number of leads, calls, or sales.

Intellectual Property

Once your project is fully paid for, you own the final website content and design we deliver specifically for you, except for third-party materials and any KILO tools, templates, code frameworks, or know-how, which remain ours and may be reused. The Site itself and all KILO branding, text, and graphics remain the property of KILO. See our Copyright Notice for details.

Third-Party Services

Your website or campaigns may rely on third-party services such as hosting, domain registrars, analytics, and advertising platforms. Those services are governed by their own terms, and we are not responsible for their availability, performance, or actions.

No Guarantee of Results

Marketing results depend on many factors outside our control, including your market, pricing, responsiveness, and the policies of search engines and advertising platforms. We provide our Services with reasonable skill and care, but we make no guarantee of specific rankings, traffic, leads, or revenue.

Limitation of Liability

To the fullest extent permitted by law, KILO will not be liable for any indirect, incidental, or consequential damages, or for lost profits or revenue. Our total liability for any claim relating to the Services will not exceed the amount you paid us for the specific engagement giving rise to the claim.

Indemnification

You agree to indemnify and hold KILO harmless from any claims or damages arising out of content or materials you provide to us, or your misuse of the Site or Services.

Termination

Either party may end an engagement as described in the applicable agreement. You remain responsible for fees for work completed up to the termination date.

Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-law rules. Any dispute will be handled in the courts located in Wyoming.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new "last updated" date, and it takes effect when posted. Continued use of the Site or Services means you accept the updated Terms.
